The petitioner apprehends his arrest in Phulpras P.S. Case No.8 of 2018 for the offences punishable under Sections 135 and 138 of the Electricity Act.

The Assistant Engineer, Electrical alleged that the petitioner was found committing theft of electrical energy and he was running flour mill. It is alleged that due to theft of electric energy by the petitioner, loss of Rs.3,60,108/- was occurred.

The learned counsel for the petitioner submits that petitioner is ready to deposit the entire amount within three months.

Considering the facts that the petitioner is ready to deposit the entire amount in three equal installments within

Patna High Court Cr.Misc. No.74623 of 2018(2) dt.19-12-2018 2/2 three months i.e. Rs.1,20,000/- and odd for each month, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. II, Jhanjharpur, Madhubani in connection with Phulpras P.S. Case No.8 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

If the petitioner fails to deposit three installments within three months from the date of this order, learned court below shall cancel the bail bond of the petitioner forthwith. (Prabhat Kumar Jha, J) Saurabh/- U T
