JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-11-2019 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest for the offences alleged under Sections 399, 402, 413 an 414 of the Indian Penal Code and Sections 25(1-b)a, and 26 and 35 of the Arms registered in connection with Nautan P.S. Case No. 14 of 2017. The prosecution case, as per written statement of one Mumtaz Alam, Station House Officer, Nautan in the district of Siwan, is that on 21.01.2017 at about 17.00 O'clock, he received secret information that some criminals assembled at Shiv Mandir in village Semaria and planning to commit a crime. After receiving such information, the informant apprised the same to the senior police officers. Thereafter as per direction of superior officers, a joint raiding party consisted of police officers of Mairwa Thana, Darauli Thana and Nautan Thana was

Thereafter the raiding party reached at village Semaria at Shiv Mandir where they apprehended four persons while other persons managed to flee away. On inquiry, the apprehended persons disclosed their names as Abhishek Kumar Singh @ Chote Sarkar, Ajit Kumar Singh, Munnu Sah @ Munna Sah and Anish Chaubey. They further disclosed the names of the co-accused persons who succeeded in fleeing away from the place of occurrence as Bittu Singh @ Bittu Rai, Pintu Rai, Prince Rai, Punit Rai, Pintu Singh and Amit Singh. On search of the apprehended accused persons, the police raiding party found following articles - one country made pistol, one Katta, one automatic pistol made U.S.A., four cartridges of 9 MM, two live cartridges and four mobile phones, two bullet motorcycle and two other motorcycles.
Learned counsel for the petitioner submits that the arrested persons disclosed the name of the petitioner. He further submits that the petitioner has no criminal antecedents. It is further submitted that the petitioner is a disabled person from one hand. In this regard learned counsel has pointed out from paragraph 6 of the impugned order in which it has been stated that a photo copy of the disability certificate has been shown in the court below.

No.66187 of 2019(2) dt.15-11-2019 3/3 In the facts and circumstances of the case, in the event of petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional District Judge-3rd, Siwan in connection with Nautan P.S. Case No. 14 of 2017 subject to the conditions as laid down under Section 438
(2) of the Cr.P.C.
