2. In the present case, the petitioner seeks bail in connection with Ramgarh P.S. Case No. 155 of 2025, dated 28.04.2025, registered for the offences punishable under Sections 115(2), 126(2), 303(2), 109(1), 352, 351(2), 3(5) of the B.N.S., 2023.

3. As per the prosecution case, in the background of dispute over drainage, the co-accused persons assaulted the informant with iron rod causing fracture. The other co-accused persons also assaulted the informant on his head with iron rod. The co-accused persons further assaulted the person who came to rescue the informant. Allegation against the petitioner is that he also assaulted the informant with iron rod on his head.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.74934 of 2025(2) dt.20-11-2025 2/3 petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. The petitioner and informant are next door neighbours. The petitioner and other accused persons assaulted the informant causing injury on his head. Learned counsel further submits that only one injury was found on the head of the informant on the left parietal region having size 2 inch x 1⁄2 inch x muscle deep and the said injury was subsequently found to be grievous due to fracture. Other injury is stated to be unconscious. Learned counsel further submits that there is case and counter case between the parties and Ramgarh P.S. Case No. 156/2025 has been filed against the informant side by the petitioner side. A number of co-accused persons have been granted anticipatory bail by a coordinate Bench vide order dated 11.08.2025 passed in Cr. Misc. No. 50970 of 2025 and the case of the petitioner is on similar footing. Petitioner is in custody since 30.08.2025 having clean antecedent.

5. Learned A.P.P. appearing on behalf of the State opposed the submission of the petitioner.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering that similarly situated co-accused persons have been granted

No.74934 of 2025(2) dt.20-11-2025 3/3 anticipatory bail by a coordinate Bench, period of custody of the petitioner and his clean antecedent, the petitioner, above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned court of Additional Chief Judicial Magistrate- 2nd , Mohania, Kaimur/ concerned Court, in connection with Ramgarh P.S. Case No. 155 of 2025, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.

(iii) In case of non-appearance of the petitioner on single date or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
