2. The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Section 376 of the Indian Penal Code, Section 4 and 8 of the POCSO Act and Section 3/7(2)(c) of Pita Act.

3. As per allegation in the FIR petitioner after alluring the victim girl, took away and forcefully pushed her in the business of flesh trade.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner is a lady and no offence of commission of rape is made out against her. In fact, petitioner is

No.85241 of 2023(2) dt.09-01-2024 2/2 a rented neighbor of the informant and informant has stolen her mobile for which a hot altercation took place thereafter informant went to the police station and lodged the present case case with false, fabricated and concocted story. Petitioner is languishing in judicial custody since 5.9.2023.

5. Learned APP appearing for the State has opposed the prayer of Bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI-sum-Special Judge, POSCO, Gopalganj in connection with Gopalganj (Town) P.S. Case No. 712 of 2023.
