Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. 2.
This application, for grant of anticipatory bail, arises out of Barachatti Police Station Case No. 932 of 2023, disclosing offences punishable under Section 379 and other allied sections of the Indian Penal Code.

The prosecution case, as per the First Information Report, is that on secret information, when the informant along with police party reached at Maa Bhawani Traders shop, they saw that iron angle was unloaded from a truck. On seeing police party, three persons tried to flee away but one person was apprehended, who disclosed the name and identity of the petitioner as proprietor of Maa Bhawani Traders. Total

Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that no stolen articles or iron angle has been recovered from the shop of the petitioner. The petitioner is stated to be accused in one more case having similar nature of offence.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that the petitioner has criminal antecedent of similar nature of offence and seizure list shows that the alleged recovery was made from near the shop of the petitioner namely Maa Bhawani Traders, I am not inclined to grant the petitioner privilege of anticipatory bail.
