Petitioner seeks bail in a case registered for the offence punishable under sections 272 and 273 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Petitioner is not named in the F.I.R. and he has been implicated in this case at the instance of co-accused. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has no concern with the recovered articles. Petitioner is in custody since 13.09.2019.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.70069 of 2019(2) dt.18-11-2019 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd A.D.J. cum- Special Judge (Excise), Purnea in connection with Special Excise Case No. 796 of 2019, arising out of Sadar P.S. Case No. 474 of 2019.
