JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 This is an application for grant of anticipatory bail in connection with Basantpur P.S. Case No. 252 of 2018, disclosing offences under Sections 272, 273, 308, 34 of the Indian Penal Code and Section 30(A), 41(i) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 4 liters liquor from the house of the petitioners.

Submission of learned counsel for the petitioners is that the petitioners have falsely implicated in this case. Further they have no criminal antecedents.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners,

Patna High Court Cr.Misc. No.78635 of 2018(2) dt.10-01-2019 2/2 above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. 2nd, Cum Special Judge, Siwan, in connection with Basantpur P.S. Case No. 252 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
