JUSTICE SHIVAJI PANDEY ORAL ORDER 27-05-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing in view of the total lock-down on account of COVID-19 pandemic. In this case, the petitioner is seeking regular bail in connection with Darauli P.S. Case No.55 of 2017 registered for offence punishable under section 304/34 of the Indian Penal Code.

Allegation has been made that the wife of the petitioner has been killed.

Plea has been taken by the petitioner that in fact she has committed suicide and placed reliance on the statement of witness mentioned in paragraph 28 of the case diary and also the younger sister of the victim, but the post mortem report show that it is not a case of suicide, but it is a case of murder.
