2. The petitioners apprehend their arrest in connection with G.B. Nagar P.S. Case No. 351 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 118, 109, 303(2) and 352, 351(2), 3(5) of the Bhartiya Nyaya Sanhita 2023.

Allegedly, on the fateful day, when the informant along with her husband had gone to the field, in the meanwhile, the petitioners entered into the house of the informant and abused and assaulted her daughter; besides also committed theft of valuables worth Rs. Two lacs. When the informant and her

No.73823 of 2025(2) dt.20-11-2025 2/3 husband came to know, they enquired the same from the petitioners, whereupon petitioner No.1 gave an iron road blow over the head of the informant due to which she sustained serious injury. It is further alleged that the accused persons also assaulted the informant's husband.

Learned Advocate for the petitioners submitted that both the parties are none else but close agnates and on account of some strained relationship and previous enmity, they entered into a scuffle resulting into some simple injuries, however, only in order to put pressure and wreak vengeance the present FIR came to be instituted. Though the informant claims to have been assaulted on the head by the petitioner, but there is no whisper in the impugned order regarding any injury much less grievous in nature. Petitioners are persons of fair antecedents and they undertake that they will fully cooperate in the proceeding of the court and would not indulge in such incidence.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the informant has sustained injury over the vital parts.

6. Regard being had to the submissions made by the learned Advocates for the respective parties and considering the

No.73823 of 2025(2) dt.20-11-2025 3/3 relationship between the parties coupled with the allegation against the petitioner qua the injury as also the fair antecedents, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.D.J.M.-IV, Siwan/Successor Court, Siwan in connection with G.B. Nagar P.S. Case No. 351 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
