The petitioner seeks bail in connection with Buxar (Muffasil) P. S. Case No. 100 of 2019 instituted for the offences under Sections 302, 379 and 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959. The son of the informant was shot at from behind while he was coming back home. The F.I.R. has been lodged against unknown person. During the course of investigation, the name of the petitioner transpired in the confession of the two accused person, namely, Rahul Kumar @ Banti Yadav and Pawan Shukla. Apart from

Patna High Court CR. MISC. No.67997 of 2019(2) dt.04-12-2019 2/2 the aforesaid confessional statement of the two accused persons, there is no other material in the entire investigation papers to connect the petitioner with the crime.

The earlier cases, in which the petitioner is reported to have been made accused, he is on bail. Regard being had to the aforesaid facts and the period of the custody of the petitioner which is from 05.08.2019, the petition is allowed.

The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar (Muffasil) P. S. Case No. 100 of 2019.
