JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-12-2018 Heard learned counsel for the petitioner, learned counsel appearing for the State and learned counsel representing opposite party no. 2- South Bihar Power Distribution Company Limited, Patna.

Petitioner is apprehending his arrest in connection with Sasaram Town PS Case No. 139/2018 for the alleged offence under Sections 420, 406, 409, 468 of the Indian Penal Code.

Learned counsel representing the petitioner submits that the petitioner has no criminal antecedent. He further submits that although the petitioner disowns the responsibility with regard to the alleged misappropriated amount of Rs.93,000/- but for the purpose of anticipatory bail he submits

Patna High Court Cr.Misc. No.71236 of 2018(2) dt.18-12-2018 2/2 that his client is ready to deposit the said amount and the deposit shall abide by the final outcome of the criminal case. Considering the aforesaid offer tendered by learned counsel for the petitioner which has been accepted by the informant and that the petitioner has no criminal antecedent, this application is allowed.

In the event of arrest or surrender before the concerned court below within a period of one month from today, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram Town PS Case No. 139 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also on the condition that the petitioner shall deposit Rs.93,000/- within a period of two months from today. Deposit of Rs.93,000/- shall abide by the outcome of the criminal case.
