====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 29-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 308 of the Indian Penal Code and Sections 30(a), 41(1) of the Bihar Prohibition and Excise Act, 2016.

Submission is that recovery of liquor is alleged from a bamboo clamp and the spy reported that the bamboo clamp was of the petitioner, whereas the witnesses have stated that the said bamboo clamp was not of the petitioner. Petitioner has got identical criminal antecedent.

Considering the entire facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Barharia Police Station Case No. 254 of 2019 pending in the court of learned 2nd Additional Sessions Judge-

Patna High Court CR. MISC. No.66358 of 2019(3) dt.29-11-2019 2/2 cum-Special Judge, Excise, Siwan.
