The petitioner seeks bail in a case registered for the offence under Sections 398/401 of the Indian Penal Code and 25(1-b)a/26/35 of the Arms Act.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted regular bail by a co-ordinate Bench of this Court in Cr. Misc. No. 25241 of 2019, which is evident from Annexure-2, and the case of this petitioner stands of similar footing. The petitioner is rotting in judicial custody since 01.07.2019.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 1027 of 2018.
