2. The petitioner in the present case is seeking a direction to the respondent authorities to consider his case for grant of benefits of Assured Career Progression (ACP) and upon consideration, to pay him the consequential benefits.

3. Learned counsel for the petitioner submits that the petitioner retired from service on 31.12.2018 after serving the State of Bihar for 35 years as Driver in the office of Child Development Project Officer, Jehanabad (Rural). He has submitted a representation

Patna High Court CWJC No.960 of 2023(2) dt.25-04-2023 2/2 on 30.05.2022 as contained in Annexure '5' to the writ application whereby a request has been made to the District Magistrate, Jehanabad and District Programme Officer, Jehanabad to consider paying the benefits of ACP to the petitioner. The representation submitted by the petitioner is said to be pending.

4. Learned counsel for the State submits that in such circumstance, an appropriate direction may be issued to the District Magistrate, Jehanabad (respondent no. 3) to consider the representation of the petitioner and pass an appropriate order thereof in accordance with law.

5. Having regard to the kind of grievance raised by the petitioner and the submissions of the State, this Court directs respondent no. 3 to consider the representation of the petitioner as contained in Annexure '5' to the writ application and take an appropriate decision thereon in accordance with the applicable rules within a period of three months from the date of receipt/production of a copy of this order.

6. Needless to say that in case the petitioner is found entitled to the benefits of ACP, the same shall be made available to him within next two months thereafter.
