The petitioner is apprehending his arrest in connection with Madhepura (Ghailarh) P.S.Case No.527 of 2018 dated 11.7.2018 , registered for offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act.
The police on suspicion intercepted the vehicle and arrested three persons and two persons succeeded fleeing away , arms and ammunition were recovered from the arrested persons and they disclosed that they were going to the village Jogbani to kidnap the daughter of Jai Prakash Yadav as one Rajendra Kumar has love affair with her and the petitioner has been made accused only because the vehicle belongs to him. Submission of the learned counsel for the petitioner is that nothing has been recovered from his possession and he has

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Madhepura in connection with Madhepura (Ghailarh) P.S.Case no.527 of 2018 dated 11.7.2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is allowed.
