JUSTICE ASHUTOSH KUMAR ORAL ORDER 27-11-2019 Mr. Arvind Kumar Pandey, learned counsel for the petitioners, submits that petitioner No. 1/Dhanji Chaudhary has been arrested. He therefore prays for withdrawing the application with respect to petitioner No. 1. Permission is accorded.

The application with respect to petitioner No. 1 is permitted to be withdrawn.

Petitioner Nos. 2 and 3 seek bail in anticipation of their arrest in connection with Natwar P.S. Case No. 55 of 2019, dated 19.07.2019, instituted for the offences under

Patna High Court CR. MISC. No.68676 of 2019(2) dt.27-11-2019 2/3 Sections 341, 323, 324, 325, 379, 307, 506 and 34 of the Indian Penal Code.

It appears that though petitioner Nos. 2 and 3 have been named in the F.I.R., but there is no specific accusation against them.

It has been submitted on behalf of the petitioners that one Ramashankar Choudhary was assaulted by the informant's side for which a case has been lodged vide Natwar P.S. Case No. 56 of 2019 under Sections 307 and 379 of the Indian Penal Code. It has further been submitted that four of the accused persons of this case having similar allegations have been granted anticipatory bail by different Benches of this Court.

Considering the aforestated aspects of the matter, the petitioner Nos. 2 and 3, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate-
