The petitioner seeks bail in connection with a case registered for the offence punishable u/s 126(2), 118(1)m 109, 74, 303(2), 3(5) of the BNSS, 2023.

As per the prosecution case, petitioner along with other co-accused persons are said to have assaulted the informant's side.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He has been falsely implicated in this case due to enmity. There is general and omnibus allegation against the petitioner. The injury found upon the injured is simple in

Patna High Court CR. MISC. No.77950 of 2024(3) dt.13-12-2024 2/2 nature. It is further submitted that similarly situated co-accused persons have been granted bail by this Court vide order dated 22.10.2024 passed in Cr. Misc. No.70694 of 2024. The petitioner has no criminal antecedent and has been rotting in judicial custody since 19.08.2024.

Learned APP for the State opposed the prayer for bail. 6.

Considering the facts and circumstances of this case and the period of custody, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Gidhaur P.S. Case No.99 of 2024.
