JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report and from perusal of the impugned order, it appears that the name of the petitioner came in confessional statement of co-accused and except the confessional statement of co-accused, there appears to be nothing against the petitioner. Moreover, the charge-sheet against the petitioner has already been submitted. The petitioner has mentioned at para 3 of the petition that earlier, nine cases were instituted against him and submission on behalf of the petitioner is that one S.I., Islam

Patna High Court CR. MISC. No.66489 of 2019(2) dt.25-10-2019 2/2 Mian, of the Bettiah Police Station implicated the petitioner in all the above stated cases due to enmity and that is why, all the aforesaid cases were registered either in the year 2003 or in the year 2004 and after 2004, except the present case, not a single case was registered against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Muffasil (Manuapul) P. S. Case No. 111 of 2019.
