JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 1692(C) of 2017, disclosing offences under Sections 323, 354, 379, 504 of the Indian Penal Code. Allegation against the petitioner is that he entered inside the house of informant abused her and assaulted her and tried to outrage and on hulla, husband of the informant came for rescue, then, the petitioner also assaulted him and snatched away Rs. 2,000/-.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and there is delay of ten days in filing the complaint petition and no such occurrence has ever taken place.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -V, Ara, Bhojpur, in connection with Complaint Case No. 1692(C) of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
