JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1272 of 2017 instituted for the offence punishable under Section 498A of the Indian Penal Code.
Earlier the matter was referred to the Patna High Court Mediation and Conciliation Centre vide order dated 12.4.2019 and the Mediator's report at Flag 'B' shows that dispute has been resolved between the parties through process of mediation in terms of settlement mutually agreed upon between them and in terms of agreement both the parties are living together and parties have to withdraw their cases. Both the parties have admitted the aforesaid fact.

In view of above facts and circumstances, the provisional bail granted to the petitioner vide order dated 10.1.2019 is confirmed and this application is allowed with condition that petitioner shall abide by the terms and conditions of the agreement mutually agreed upon between the parties and it is expected that opposite party No.2 shall also respect the terms and condition of the agreement.
Let copy of the report of Mediator along with the memorandum of agreement be sent to the court concerned forthwith for needful.
