JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 Petitioner apprehends his arrest in connection with Kako P.S.Case No. 170 of 2018 registered for the offences punishable under Sections 306/34 of the Indian Penal Code. Allegation as per FIR against the petitioner is that he used to commit mental torture on the informant and due to that he committed suicide.

Submission of learned counsel for the petitioner is that no specific allegation has been alleged about the mental torture against the petitioner and the family members of the informant got his discharged from the hospital and petitioner is 'Saru' of the informant.

Heard learned APP also.

Having heard both sides and in the facts and circumstances and also considering the statement of the

Patna High Court Cr.Misc. No.77633 of 2018(2) dt.02-01-2019 2/2 deceased-informant, let petitioner, above named, surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by the order of this Court. With the above observation, this application is dismissed.
