The petitioner seeks bail in a case registered for the offence under Sections 363, 366-A/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the victim in her statement recorded under Section 164 Cr.P.C. has disclosed a false story at the behest of her parents and she also disclosed her age as 16 years but the Medical Board after her examination opined that she is of 18-19 years of her age and does not find any evidence of recent sexual

Moreover, there was lover affair between the victim and the petitioner and victim herself fled away with the petitioner. The petitioner is rotting in judicial custody since11.07.2019. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra, in connection with Dariyapur P.S. Case No. 200 of 2019.
