JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 This application, for grant of anticipatory bail, arises out of Excise Case No. 756 of 2019 arising out of Ghosi (Okari O.P.) P.S. Case No. 241/2019, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act. Police on secret information, raided the place of occurrence and recovered country made liquor and other articles for manufacturing of liquor and on enquiry, police came to know that petitioner and others are engaged in manufacturing of illicit liquor.

Submission of learned counsel for the petitioner is that he has been made accused in this case only on the basis of suspicion and except that there is nothing against the petitioner and further the source of information with regard to involvement of the petitioner in manufacture of liquor has not

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Jehanabad, in connection with Excise Case No. 756 of 2019 arising out of Ghosi (Okari O.P.) P.S. Case No. 241/2019, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.
