JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 This is an application for grant of anticipatory bail in connection with Rahui P.S. Case No. 211 of 2018, disclosing offences under Sections 341, 323, 308, 504/34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be the Devar of the informant, that he along with other accused persons has assaulted the informant with iron rod. Submission of learned counsel for the petitioner is that F.I.R. itself shows that the matter relates to family dispute and the impugned order shows that injury is simply in nature. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court

Patna High Court Cr.Misc. No.78175 of 2018(2) dt.07-01-2019 2/2 below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Rahui P.S. Case No. 211 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
