The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 387, 379, 447/34 of the Indian Penal Code.

Prosecution case, in short, is that a few months back co-accused Irfan demanded Rs.2 lacs as rangdari which the informant did not oblige. Thereafter co-accused Irfan along with three others came to the house of the informant and seriously assaulted the informant and his family members who sustained serious injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.08.2019 and has got no

Patna High Court CR. MISC. No.68615 of 2019(2) dt.25-10-2019 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The allegation is of stabbing as to when the injury report shows that the injury has been caused by hard and blunt substance. The nature of injury is said to be simple. Hence, no offence under Section 307 of the I.P.C. is made out.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Bettiah Town (Kalibag O.P.)
