This application for anticipatory bail arises out of Beldour P.S. Case No. 99 of 2018, disclosing offences under Sections 341, 323, 504, 506, 379 and 307/34 of the Penal Code and Section 27 of the Arms Act.

Learned counsel, appearing on behalf of the petitioner, has submitted that his implication in the present case is false and malicious. He has further submitted that, though the allegation against the petitioner is of having shot fire on the informant, causing injury, the injury report belies the case of the prosecution. The medical expert has not found the injury to be serious.

Considering the above, the application is allowed.

Patna High Court Cr.Misc. No.73025 of 2018(2) dt.18-12-2018 2/2 Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria in Beldour P. S. Case No. 99 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bond shall be liable to be cancelled.
