JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-11-2019 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. The petitioner seeks Regular Bail in connection with Kudhni (Fakuli O. P.) P. S. Case No. 497 of 2019, registered for the offence punishable under Section 7 of the Essential Commodities Act.

The allegation is regarding a truck having been caught by the villagers which was loaded with wheat and it appeared that the said wheat belonged to FCI and was being ferried for the purposes of black marketing. The petitioner is stated to be the Khalasi of the said truck.

Patna High Court CR. MISC. No.75158 of 2019(3) dt.25-11-2019 2/2 submitted that the wheat is no longer a controlled item and the same has been decontrolled, vide notification, dated 15.02.2002. The learned senior counsel for the petitioner has further submitted that the petitioner is having a clean antecedent and languishing in custody since 03.08.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on Regular Bail.

Accordingly, the above named petitioner is directed to be enlarged on Regular Bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate (West), Muzaffarpur in connection with Kudhni (Fakuli O. P.) P. S. Case No. 497 of 2019.
