2. The petitioner seeks bail in connection with Khusrupur P.S. Case No. 110 of 2023 registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, One Shyam Kumar is the assailant of the deceased. The petitioner is said to have caught hold of the hand of the deceased. He is in jail since 25.05.2024 and he has no criminal antecedent.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case. Similarly situated co-accused person has already been granted regular bail by this Court vide order dated 03.05.2024 passed in Cr. Misc. No. 6949 of 2024.

5. Considering the facts and circumstances of the

Patna High Court CR. MISC. No.76897 of 2024(2) dt.11-12-2024 2/2 case, also considering the period of custody and also similarly situated co-accused person has been granted bail by this Court, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna City, District- Patna in connection with Khusrupur P.S. Case No. 110 of 2023, with a condition that the petitioner will cooperate in the trial either by personally or through his lawyer in the trial court on each and every date fixed for hearing.

7. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the criminal antecedent of the petitioner. If the Court below finds that the petitioner has no criminal antecedent, his bail bonds shall be accepted. If the Court below finds that the petitioner is involved in any other case, his bail bonds shall not be accepted.
