The petitioner has filed the instant application for grant of regular bail in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 444 of 2022 registered under sections 307, 504, 506, 427 and 34 of the Indian Penal Code and Section 25(1-b)a/26/27 of the Arms Act.

As per FIR, the allegation against the co-accused persons including this petitioner is that they came at the house of the informant and co-accused, Manu Yadav took out pistol from his waist and fired on the informant, due to which he sustained fire arm injury on his left side of the stomach. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

Patna High Court CR. MISC. No.73870 of 2022(2) dt.22-03-2023 2/2 falsely been implicated in this case due to village politics. Nothing has been recovered from the possession of the petitioner. The specific allegation of firing on the informant is against co-accused, namely, Manu Yadav not against this petitioner. It is further submitted that a general and omnibus allegation has been levelled against the petitioner. Nothing cogent material came against him. He is languishing in judicial custody since 04.08.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 444 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur.
