====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-12-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 316(2), 318(4), 61(2) of the Bharatiya Nyaya Sanhita and Section 7 of the Essential Commodities Act.

3. It is alleged that during inquiry of PDS shop of the petitioner, several irregularities were found. Petitioner was found charging Rs. 44/- per liter extra on Kerosene oil and some baggage of grains were also found indicating black marketing and manipulation during weights and measurements.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner has falsely been implicated in this case due to village politics. It is further submitted that during pendency of the case, Block

Patna High Court CR. MISC. No.72698 of 2025(3) dt.08-12-2025 2/2 Officer (SDO), East Muzaffarpur has already cancelled the dealership of this petitioner as such, she has already been sufficiently punished. Petitioner is lady and claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the fact that PDS dealership of the petitioner has already been cancelled and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of her arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, East Muzaffarpur in connection with Sakra P. S. Case No. 554 of 2024, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
