Petitioner apprehends his arrest in Nautan (Jagdishpur) P.S. Case No.399 of 2018, registered under Sections 308, 379, 427 and other minor sections of the Indian Penal Code.
The informant alleged that when he went to see his paddy field, he saw that petitioner and others were harvesting his paddy field. On the order of Dukhi Sah, petitioner Ajay Kumar @ Ajay Kumar Sah is alleged to have assaulted the informant with lathi on different parts of his body. It is further alleged that Dukhi Sah, Antima Kumari and Neha Kumari also assaulted him all over his body.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.73975 of 2018(2) dt.19-12-2018 2/2 petitioner happens to be the co-sharer of the informant. There is land dispute. The informant got one multiple bruise over back side of chest and swelling over mid parietal region of skull. Four persons are alleged to have assaulted the informant. Both the injuries are simple in nature and caused by hard and blunt object.
Considering the facts and nature of allegation made against the petitioner and the fact that the petitioner happens to be the co-sharer of the informant and occurrence took place due to land dispute, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Nautan (Jagdishpur) P.S. Case No.399 of 2018, subject to the conditions laid down under Section 438(2) Cr. P.C.
