2. The petitioner has prayed for bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code.
3. The prosecution case relates to recovery of a mobile from the possession of the petitioner.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case only on the basis of suspicion and there is no evidence against him. The petitioner is the owner of alleged recovered mobile which was purchased by him from the shop of mobile
Patna High Court CR. MISC. No.77887 of 2023(2) dt.05-12-2023 2/2 phone so no offence u/s 414 of the I.P.C. is made out against him. Petitioner is languishing in judicial custody since 03.06.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Rail, Bhagalpur in connection with Rail Bhagalpur P.S.
