Smt. Asha Devi ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 Petitioner apprehends his arrest in connection with G.O. Case No. 237 of 2018, arising out of L.N.M.U. P.S. Case No. 47 of 2018 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 55 litres of liquor from the rented house of the petitioner.
Submission of learned counsel for the petitioner is that recovery has been made from the rented house and not from conscious possession of the petitioner and he has no criminal antecedent.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest
Patna High Court Cr.Misc. No.78741 of 2018(2) dt.10-01-2019 2/2 or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IV-cum-Special Judge, Darbhanga, in connection with G.O. Case No. 237 of 2018, arising out of L.N.M.U. P.S. Case No. 47 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
