The petitioner has prayed for bail in a case registered for the offence punishable under section 414 of the Indian Penal Code.

As per allegation in the FIR, outside the gate of F.C.I. for the purpose of black-marketing, 32 quintal wheat in 68 bags and 6.5 quintal of rice kept in 12 bags were recovered from two motor-laced cart and cart puller managed to escape from the spot.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is simply a cart-puller. He has no concern with the food grains. Petitioner was neither arrested on spot nor anything recovered

Patna High Court CR. MISC. No.74604 of 2022(3) dt.21-03-2023 2/2 from his house or his conscious possession. Petitioner is languishing in judicial custody since 19.09.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the above facts, and the period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Barh, Patna in connection with Mokama P.S. Case No. 253 of 2015.
