The petitioner is apprehending his arrest in connection with Panapur P.S.Case No.162 of 2018 dated 11.10.2018 registered for offences punishable under Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act.

Allegation as per FIR is of recovery of 600 ltrs. of liquor form the bank river and several accused persons succeeded in fleeing away including the petitioner and it further appears that the petitioner is accused in other cases also. Submission of the learned counsel for the petitioner is that nothing specific has been recovered from his possession and he has been falsely implicated in this case as well as having no criminal antecedent.

Patna High Court Cr.Misc. No.1577 of 2019(2) dt.23-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
