JUSTICE SANDEEP KUMAR ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 15.08.2022 in connection with Nanpur P.S. Case No. 262 of 2022 registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.
Considering the fact that no specific allegation of assault has been levelled against the petitioner and also considering the fact that he is in custody since 15.08.2022, this application for regular bail is allowed.
In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail after framing of charge if the charge in not framed yet or on
Patna High Court CR. MISC. No.73629 of 2022(2) dt.04-03-2023 2/2 furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Nanpur P.S. Case No. 262 of 2022. The petitioner would cooperate in the proceeding of the Court below. If the petitioner tries to delay the trial, the Court below is at liberty to pass an appropriate order including the cancellation of bail bonds of the petitioner. The petitioner is directed to appear before the Court below through his lawyer or himself on each date, failing which, his bail bonds shall be cancelled.
