Mr.Dr. Ajeet Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-03-2023 Heard learned counsel for the petitioner, learned APP for the State as well as learned counsel appearing on behalf of the informant.
The petitioner apprehends his arrest in connection with Aurangabad (Town) P.S. Case No.346 of 2022, registered for the offences punishable under Sections 341, 323, 504 and 498(A) of the Indian Penal Code.
The petitioner is said to have tortured the sister of the informant physically and mentally for non-fulfillment of demand of additional dowry.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got one
Patna High Court CR. MISC. No.74200 of 2022(2) dt.28-03-2023 2/3 criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that the wife of the petitioner had earlier lodged Patrakar Nagar P.S. Case No.59 of 2022, dated 07.02.2022, under Sections 498(A), 406 and 307 of the Indian Penal Code, which is still pending and the matter was compromised between the parties. It is submitted that brother of the petitioner's wife has lodged the instant case again under Section 498(A) and other sections of the Indian Penal Code. It is further submitted that the petitioner has left his service due to this case.
Learned APP for the State and learned counsel for the informant opposed the prayer for grant of anticipatory bail to the petitioner and submit that the sister of the informant is still ready to live with the petitioner.
Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Aurangabad (Town) P.S. Case No.346 of 2022, subject to the conditions laid down under
Patna High Court CR. MISC. No.74200 of 2022(2) dt.28-03-2023 3/3 Section 438(2) of the Code of Criminal Procedure. If so advised, either of the parties will be at liberty to make an application before the learned court below for referring the matter to the District Mediation Centre for the purpose of reconciliation or for one time settlement.
