====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2019 Heard learned counsel for the petitioner and learned A.P.P.

The petitioner seeks anticipatory bail in connection with Complaint Case No. 1621C of 2012, registered for offences punishable under Sections 498A and 323 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Allegation as per F.I.R. against the petitioner, who happens to be the husband of the complainant is of subjecting her to torture due to non fulfillment of demand of dowry and ousted his wife from his house.

Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case

Patna High Court Cr.Misc. No.709 of 2019(4) dt.05-02-2019 2/2 and the complainant also in her solemn affirmation stated that she will not live with the petitioner even she was asked to live with the petitioner and the petitioner has no criminal antecedent. Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- ( Twenty five thousand) with two sureties of the like amount each in connection with Complaint Case No. 1621C of 2012 to the satisfaction of learned Sub Divisional Judicial Magistrate, Jamui, subject to the conditions laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
