1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Joki-Hat P.S. Case No. 290 of 2023 registered under Section 302 and other allied sections of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to personal enmity and grudge as well as dirty village politics. Further he submits that from perusal of the first information report itself, it is apparent that there is specific allegation of assault by means of Dabia against co-accused Md. Mojib. Petitioner has no criminal antecedent.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Judicial Magistrate, Araria in connection with Joki-Hat P.S. Case No. 290 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) shailendra/- U T
