The petitioners are apprehending their arrest in connection with Bettiah Muffasil P.S.Case No.357 of 2018 , registered for offences punishable under Sections 341, 342, 323, 366, 376, 379, 385, 506/34 of the Indian Penal Code. Allegation as per FIR is that Sitesh Kumar has kidnapped and committed rape upon the informant and taken away the ornaments and cash. Petitioners are the mother and father of the co-accused Sitesh Kumar.
Submission of the learned counsel for the petitioners is that the main allegation is against the son of the petitioners and only allegation against them is that they kept the ornaments of the informant and she is major.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.78805 of 2018(2) dt.11-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Bettiah Muffasil P.S.Case No.357 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case..
With the aforesaid observation, this application is allowed.
