Petitioner seeks pre-arrest bail in Rail Gaya P.S.Case No.173 of 2018 registered under Sections 420, 406 and 323 of I.P.C.
Allegation against the petitioner and other accused persons who is contractor in Webtech Redefining Enterprise Solution and who has worked as out sourcing in the Department of Railway on the contract basis and the petitioner had appointed the informant for the same and he used to pay Rs.5000/- per month in place of Rs.13,156/- and after getting false signature of petitioner and other employees made manupulation encash the bill coming in collusion of other coaccused persons and made defalcation of the amount. No.1375 of 2019(2) dt.18-01-2019 2/2 petitioner is that enquiry as contained in Annexure-2 made by the railway authority clearly shows that non-graduate employees were removed. As such, Ajay Prasad not made complaint rather he has stated that he was trying to resolve the matter. Further submission is that matriculate employees have been removed for which the present case has been filed.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances of the case, as discussed above, and as a mater of the fact the matter is under investigation, let the petitioner surrender before the court below within a period of six weeks from today and on his so surrendering he will be released on provisional bail by learned court below to his own satisfaction on submission of the charge sheet with condition that he will cooperate in the investigation and produce all papers, but once after charge sheet is submitted petitioner has to surrender and make prayer for bail which shall be considered on the basis of the materials available on the record.
