The petitioner has approached this Court for setting aside the order contained in memo no. 460 dated 31.08.2018 passed by the learned Sub-Divisional Officer, Madhubani by which the PDS License of the petitioner has been cancelled. Learned senior counsel for the petitioner submits that his license has been cancelled by a non-speaking order and that too without considering the show cause filed by him. After some arguments, he seeks liberty to file a fresh representation before the Sub-Divisional Officer, Madhubani.

Without going into the merits of the case, this writ

Patna High Court CWJC No.21792 of 2019(2) dt.07-01-2021 2/2 application is disposed off with a direction to respondent no. 3the Sub- Divisional Officer, Madhubani that if the petitioner files a fresh representation along with a copy of this order before him, the same shall be considered and he would pass a reasoned and speaking order within a period of four months from the date of filing of the representation. It is made clear that respondent no. 3 would be solely responsible for non-compliance of this order within the stipulated period.

With the aforesaid direction, this writ application stands disposed off.
