Petitioner apprehends arrest in connection with Excise Case No. 761 of 2018 arising out of Ara Nawada P.S. Case No. 276 of 2018 registered for the offence punishable under sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely because he is owner of the Ambulance in question from where the alleged recovery of illicit liquor has been made. As a matter of fact, nothing has been recovered from the conscious possession of this petitioner. Petitioner has no concern with the alleged recovery. Petitioner is a man of clean antecedent.

No.75851 of 2018(2) dt.20-12-2018 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Bhojpur, Ara in connection with Excise Case No. 761 of 2018 arising out of Ara Nawada P.S. Case No. 276 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
