JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 Petitioner seeks bail in anticipation of her arrest in connection with Bidupur P.S. Case No. 183 of 2019, registered for the offences punishable under Sections 304 (b)/34 of the Indian Penal Code.

As per FIR petitioner happens to be mother-in-law in a case of dowry death.

Submission of learned counsel for the petitioner is that there is no specific allegation has been attributed to the petitioner and father-in-law of the deceased has already been granted privilege of anticipatory bail by co-ordinate Bench of this Court vide order dated 26.08.2019 passed in Criminal Misc. No. 53008 of 2019.

On the other hand, learned A.P.P. has opposed the prayer of bail but has not controverted the fact above fact that

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above named, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No.-183 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
