Petitioner is apprehending his arrest in connection with Tajpur PS Cae no.255 of 2017 , registered for offences punishable under Sections 120(B), 324, 326, 307/34 of the Indian Penal Code and Sections 27, 25(1-B)a, 26/35 . As per FIR, petitioner is not named in the FIR and the allegation of firing is against one Kanhaiya Ram on the chest of the informant causing injury and later on his name transpired during the course of confessional statement of the co-accused. Submission of the learned counsel for the petitioner is that there is nothing against the petitioner and even in confession, he is not said to be the person who has fired on the informant and other co-accused persons have been granted

Patna High Court CR. MISC. No.66804 of 2019(3) dt.23-10-2019 2/2 anticipatory bail by a Co-ordinate Bench of this Court vide order dated 22.7.2019 passed in Cr. Misc. No.28831 of 2019 and order dated 21.12.2017 passed in Cr. Misc. No.61740 of 2017 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Ist, Samastipur in connection with Tajpur P.S.Case No.255 of 2017 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
