Petitioner seeks pre-arrest bail in Piprakothi P.S.Case No.102/18 registered under Section 498A/34 of I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act. Allegation against the petitioner is of subjecting cruelty and harassment to the informant on account of nonfulfillment of demand of dowry. Submission on behalf of the learned counsel for the petitioner is that the petitioner is still ready to keep the O.P.No.2 with full dignity and honour if she is ready and willing to live with the petitioner. Further submission is that the petitioner has already filed Matrimonial Case No.188 of 2018 under Section 9 of the Hindu Marriage Act.

No.79505 of 2018(2) dt.11-01-2019 2/2 Having heard both sides and in view of the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the learned court below within six weeks from today be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M., East Champaran, in Piprakothi P.S.Case No.102/18 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further condition that the bailors must be of local having sufficient movable and immovable properties within the jurisdiction of the court concerned.
