JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-05-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 143, 341, 323, 324, 307, 379, 448, 509, 504, 506 of the Indian Penal Code.
Allegedly, after some altercation, this petitioner along with other accused persons armed with deadly weapons came to the informant and started abusing and when he objected, coaccused, Md. Rahim, assaulted him by means of Farsa whereas co-accused, Md. Mukhtar, assaulted the nephew of the informant with iron rod.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Both the parties are co-villagers. Specific accusation of assault
Patna High Court CR. MISC. No.2833 of 2023(2) dt.11-05-2023 2/2 is against other accused persons. No such occurrence as alleged ever took place. Petitioner has been falsely implicated in this case due to dirty village politics. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. This case is counter blast of Rajnagar P.S. Case No. 228 of 2022. The injuries sustained by the victims are simple in nature. Petitioner has no criminal antecedent as mentioned in para-3 of this application.
Learned APP for the State opposed the prayer for bail.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Madhubani in connection with Rajnagar P.S. Case No. 261 of 2022, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
