2. The petitioners apprehend their arrest in connection with Nardiganj P.S. Case No. 264 of 2025, registered for the offences punishable under Sections 351(2), 352, 126(2), 127(2), 109, 115(2), 190, 191(2), 191(3), 308(2) of the BNS, 2023.
3. Allegation against the petitioners is of causing assault by means of butt of the pistol over the head of the informant and his brother respectively due to which they sustained serious injuries.
4. Learned Advocate for the petitioners submitted that in fact on account of previous enmity, the name of the petitioners have been implicated in this case. No.74672 of 2025(2) dt.25-11-2025 2/3 been allegedly sustained to the informant and his brother have been found to be simple in nature as is evident from the impugned order. The petitioners undertake that they will fully cooperate in the proceeding of the court and would not indulge in such activity.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioner No. 1 carries four criminal antecedent, whereas petitioner No. 2 is involved in two criminal cases.

Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the accusation against the petitioners, coupled with the simple nature of injury, besides the undertaking before this Court, as also mere criminal antecedent of a person cannot be the sole ground to refuse the bail, unless there is other cogent material, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Nawada in connection with Nardiganj P.S. Case No. 264 of 2025, subject to the
Patna High Court CR. MISC. No.74672 of 2025(2) dt.25-11-2025 3/3 conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
