2. The petitioner seeks bail in Ramgadhwa (Ramgarhwa) P.S. case No. 234 of 2025 instituted for the offences under Sections 126(2), 115(2), 118(2), 109, 74, 351(2), 3(5) of Bharatiya Nyaya Sanhita, 2023.

3. Prosecution allegation, in short, is that on a trivial issue regarding playing of children, some verbal altercation took place and the accused persons including the petitioner, in an aberated condition, starting assaulting the daughter of the informant, in the meantime, informant came to save her then the petitioner along with others also assaulted the informant due to

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. There is delay of three days in lodging the F.I.R. Learned counsel further submits that no occurrence as alleged has taken place. Both the parties are gotiyas and there is subsisting land dispute between the parties. Learned counsel submits that the informant is in habit of filing false cases against the petitioner. The husband of the informant does not live at home and due to wrong suggestion of her associates, the present case has been lodged after three days. The petitioner is in custody since 03.07.2025 and has no criminal antecedent

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. He further submits that there is allegation against the petitioner, hence, he dies not deserve bail.

6. Considering the aforesaid facts and circumstances of the case, clean antecedent of the petitioner and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail, after framing of charge, if not already framed, on furnishing bail bonds of
