JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2018 The petitioner seeks bail in anticipation of her arrest in connection with Bodh-Gaya P.S. Case No. 637 of 2017, dated 13.11.2017, instituted for the offences under Sections 147, 148, 149, 324, 326, 307 and 302 of the Indian Penal Code.

The father of the informant, who is the deceased of this case, is alleged to have been dashed on the ground by the petitioner as well as the wife of one Shatrughan

Patna High Court Cr.Misc. No.76519 of 2018(2) dt.21-12-2018 2/3 Pandey, viz., Manita Kumari @ Manita Pandey. Thereafter, the father of the informant (deceased) and others were assaulted by other named accused persons of this case. The learned counsel for the petitioner has submitted that but for the allegation of throwing the deceased on the ground prior to his being assaulted, there is no further allegation against the petitioner. It has also been submitted that the mother-in-law of the informant had a different story to narrate, which is the counter version of the occurrence contained in Annexure-2 of this bail application. Lastly, it has been submitted that similarly situated coaccused person, viz., Manita Kumari @ Manita Pandey, W/o Shatrughan Pandey has been granted anticipatory bail by a Bench of this Court vide order dated 08.08.

Patna High Court Cr.Misc. No.76519 of 2018(2) dt.21-12-2018 3/3 the present order, is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Bodh-Gaya P.S. Case No. 637 of 2017 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
